These BHS In-Store Terms & Conditions ("Terms") establish the general policies, operational conditions, customer responsibilities, transaction procedures, and business standards of Broadway Hardware Store ("BHS," "Broadway Hardware Store," "we," "our," or "us"). These Terms apply to all customers, visitors, contractors, businesses, organizations, account holders, and individuals interacting with Broadway Hardware Store in any capacity.

By entering the premises, browsing merchandise, requesting assistance, making purchases, submitting payments, placing orders, requesting deliveries, enrolling in programs, participating in memberships, or otherwise conducting business with BHS, customers acknowledge that they have read, understood, and agreed to these Terms & Conditions.

These Terms are intended to serve as the primary general in-store policy document of Broadway Hardware Store. Additional policies, including but not limited to Privacy Policies, Warranty Limitations, Website Policies, Contractor Account Policies, Delivery Policies, Membership Policies, and other operational documents, may also apply separately where applicable.

GENERAL STORE POLICY

Broadway Hardware Store operates as a hardware, plumbing, electrical, building materials, tools, contractor supply, home improvement, and business support retailer serving residential customers, contractors, businesses, and organizations.

  • Because retail operations, supplier availability, transportation conditions, inventory levels, market pricing, manufacturer requirements, and operational needs frequently change, all products, services, pricing, promotions, inventory availability, memberships, discounts, and programs are subject to modification without prior notice.
  • BHS reserves the right to refuse service, limit transactions, restrict quantities, deny applications, cancel orders, modify pricing, correct errors, suspend promotions, or update operational procedures whenever necessary for business, safety, inventory-control, fraud-prevention, legal, or operational reasons.
  • Management decisions regarding returns, exchanges, transaction approvals, account verification, pricing disputes, membership eligibility, product limitations, and policy interpretation shall remain final to the fullest extent permitted by law.

PRICING, PRODUCT AVAILABILITY & INVENTORY CONDITIONS

Product pricing at Broadway Hardware Store may change at any time due to supplier price increases, freight costs, manufacturer adjustments, import costs, market fluctuations, inventory shortages, seasonal demand, transportation expenses, or operational conditions.

  • While BHS makes reasonable efforts to maintain accurate pricing and inventory information, the Store does not guarantee that all products displayed in-store, online, in advertisements, on social media, in estimates, invoices, emails, promotional materials, or verbal discussions will always remain available at the same price, quantity, specification, or packaging condition.
  • Certain products may occasionally become temporarily unavailable, delayed, backordered, discontinued, supplier-restricted, or limited in quantity without notice.
  • Inventory systems may experience technical delays, synchronization issues, barcode inconsistencies, or supplier reporting errors that may affect displayed inventory counts or pricing accuracy.
  • In the event of pricing mistakes, supplier errors, advertisement inaccuracies, technical malfunctions, or system-related issues, BHS reserves the right to correct pricing, modify transactions, limit quantities, cancel affected orders, or refuse transactions involving obvious errors or misuse.
  • Quotes, estimates, and verbal pricing discussions are informational only unless confirmed in writing by authorized management.

PAYMENTS, BILLING & TRANSACTION SECURITY

Broadway Hardware Store accepts approved payment methods including cash, debit cards, credit cards, approved electronic payments, and approved business transactions. Accepted payment methods may change at any time based on operational or financial requirements.

  • Certain transactions may require identification, signature verification, billing verification, address confirmation, business documentation, management approval, or additional authorization procedures before completion.
  • BHS reserves the right to delay, refuse, investigate, or cancel transactions involving suspicious activity, verification concerns, fraudulent behavior, unauthorized payment usage, disputed transactions, chargeback abuse, false claims, unusual purchasing activity, or operational risk concerns.
  • Customers are responsible for carefully reviewing all receipts, invoices, pricing, quantities, payment information, taxes, and transaction details before completing purchases or leaving the premises.
  • Returned checks, fraudulent transactions, chargebacks, payment reversals, unauthorized disputes, or misuse of payment systems may result in denial of future service, membership suspension, account restrictions, financial recovery procedures, or legal reporting where permitted by law.

ONLINE PAYMENTS & ELECTRONIC TRANSACTIONS

Broadway Hardware Store may accept online or electronic payments for approved products, invoices, memberships, deposits, special orders, contractor services, account balances, wholesale programs, or other authorized transactions.

  • Customers submitting online payments are responsible for providing accurate and complete billing information, payment authorization, contact information, and transaction details.
  • BHS does not guarantee uninterrupted operation of websites, online portals, payment processors, internet-based systems, communication platforms, or third-party electronic services.
  • Technical failures, banking delays, internet outages, software malfunctions, cybersecurity incidents, payment processor interruptions, or third-party service disruptions may occasionally affect electronic transactions.
  • BHS reserves the right to cancel, suspend, delay, refuse, verify, or investigate any online transaction involving suspected fraud, unauthorized activity, verification failures, suspicious purchasing behavior, inaccurate information, or payment disputes.
  • Any misuse of electronic payment systems, fraudulent activity, or chargeback abuse may result in immediate cancellation of services, account suspension, denial of future transactions, financial recovery efforts, or reporting to financial institutions or law enforcement where applicable.

FINAL SALE & NON-RETURNABLE PRODUCTS

For safety, sanitation, manufacturer, inventory-control, operational, and regulatory reasons, certain items sold by Broadway Hardware Store are considered final sale and are not eligible for return, exchange, refund, or store credit once sold, opened, installed, used, modified, or otherwise altered.

  • Electrical products, wiring, switches, breakers, outlets, lighting components
  • Plumbing products once opened or installed
  • Gas-related fittings
  • Paint products, mixed paint, chemicals, adhesives, sealants, hazardous materials
  • Opened security cameras, CCTV systems, networking equipment
  • Clearance merchandise, discounted inventory, special-order products, custom-cut materials, seasonal products, software-based products, installed items, used products, or discontinued inventory
  • BHS reserves the right to inspect all merchandise before approving any return or exchange request and may refuse requests involving damaged products, missing parts, unsafe conditions, product tampering, abuse, excessive wear, misuse, fraud concerns, or violations of Store policy.

RETURNS & EXCHANGES

Where permitted, eligible products may be returned or exchanged within fourteen (14) days of purchase unless otherwise stated in writing or restricted by product category.

  • Products must generally remain unused, unopened, undamaged, in original packaging, and in resalable condition with all included parts, accessories, manuals, tags, and documentation present.
  • A valid original receipt or approved proof of purchase is required.
  • Refunds are generally issued to the original form of payment only unless otherwise approved by management or required by law.
  • Processing times for refunds may vary depending on payment providers, financial institutions, transaction methods, fraud reviews, or banking procedures.
  • BHS reserves the right to deny returns involving installation, product modification, missing components, water exposure, electrical damage, excessive wear, unsafe conditions, fraudulent claims, receipt manipulation, suspicious activity, policy abuse, or excessive return history.

SPECIAL ORDERS & CUSTOM REQUESTS

Certain products may require special ordering from suppliers, manufacturers, distributors, or third-party vendors. Special-order products may require full payment, deposits, signed approval, additional verification, or management authorization before processing.

  • Special-order items are generally non-refundable and non-cancellable once supplier processing, ordering, manufacturing, shipping, or preparation has begun.
  • Estimated delivery dates, arrival times, shipping schedules, or supplier timelines are estimates only and are not guaranteed.
  • Delays may occur due to supplier shortages, transportation issues, customs delays, weather conditions, labor shortages, freight disruptions, manufacturer limitations, or events outside the control of BHS.
  • Customers are fully responsible for verifying measurements, compatibility, specifications, quantities, intended use, dimensions, color selections, and project requirements before approving special orders.

PRODUCT USE, INSTALLATION & SAFETY RESPONSIBILITY

Customers are solely responsible for the safe handling, transportation, storage, installation, maintenance, operation, and lawful use of all products purchased from Broadway Hardware Store.

  • Hardware products, plumbing materials, electrical products, tools, machinery, ladders, chemicals, adhesives, paints, fasteners, building materials, and related merchandise must be used according to manufacturer instructions, safety recommendations, applicable regulations, and local building codes.
  • BHS does not guarantee installation results, code compliance, project compatibility, or third-party labor quality.
  • Customers are responsible for consulting licensed professionals, certified contractors, electricians, plumbers, or technicians where specialized knowledge, permits, inspections, or regulated work may be required.
  • BHS shall not be responsible for injury, property damage, project failure, code violations, financial loss, equipment failure, misuse, negligence, unauthorized modifications, improper installation, or unsafe handling resulting from customer actions or third-party services.

GENERAL INFORMATION & ADVICE DISCLAIMER

Any guidance, recommendations, technical discussions, product suggestions, demonstrations, installation opinions, project ideas, or informational assistance provided by BHS employees or representatives are offered strictly for general informational purposes only.

  • Every project, property, installation environment, and legal requirement may differ; customers remain solely responsible for verifying measurements, specifications, compatibility, safety procedures, manufacturer instructions, permit requirements, and compliance with local, state, or federal regulations.
  • BHS does not guarantee that verbal recommendations, demonstrations, or informational discussions will meet specific project needs, contractor requirements, engineering standards, inspection requirements, or legal compliance obligations.

CUSTOMER CONDUCT & STORE SAFETY

Broadway Hardware Store is committed to maintaining a safe, professional, respectful, and secure environment for customers, employees, vendors, contractors, and visitors.

  • Disruptive behavior, threats, harassment, aggressive conduct, theft, attempted theft, fraud, property damage, unsafe handling of merchandise, interference with employees, abusive language, intimidation, unauthorized solicitation, tampering with products, interference with security systems, or violations of Store policies will not be tolerated.
  • BHS reserves the right to refuse service, deny transactions, cancel purchases, remove individuals from the premises, preserve surveillance evidence, restrict future access, or contact law enforcement whenever necessary.
  • Customers are expected to exercise caution while on Store property due to the presence of heavy merchandise, industrial shelving, tools, machinery, sharp objects, electrical products, and construction materials.

CCTV & SECURITY MONITORING

For safety, theft-prevention, operational, training, insurance, fraud-prevention, and security purposes, portions of Broadway Hardware Store and surrounding property may be monitored and recorded through CCTV and security surveillance systems.

  • By entering the premises, customers acknowledge and consent to video monitoring where permitted by applicable law.
  • Recorded footage may be reviewed, stored, preserved, or shared with authorized personnel, financial institutions, insurance companies, investigators, legal representatives, or law enforcement agencies where necessary for investigations, disputes, fraud prevention, theft investigations, safety incidents, operational review, or legal compliance.

MEMBERSHIPS, PROGRAMS & BUSINESS ACCOUNTS

Participation in BHS programs, memberships, contractor pricing structures, wholesale programs, ProLine™, BHS Builder, or business-account services is subject to eligibility review, verification procedures, operational approval, and ongoing compliance with applicable program requirements.

  • Submission of applications, forms, business information, tax documentation, identification, or payment does not guarantee approval or continued participation.
  • BHS reserves the right to modify pricing structures, membership fees, benefits, eligibility requirements, account conditions, purchasing access, discount structures, or program policies at any time without prior notice.
  • Membership abuse, unauthorized account sharing, suspicious purchasing behavior, policy violations, false information, fraud concerns, unpaid balances, or misuse of program benefits may result in suspension, termination, account restrictions, or denial of future participation.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Broadway Hardware Store, its owners, management, employees, affiliates, suppliers, representatives, contractors, and related parties shall not be liable for indirect, incidental, special, punitive, or consequential damages arising from purchases, transactions, project delays, supplier shortages, installation issues, delivery delays, product misuse, contractor performance, service interruptions, technical failures, inventory conditions, or business operations.

  • Any liability associated with a product, transaction, or service shall be limited to the amount actually paid for the specific product or service involved unless otherwise required by applicable law.

POLICY UPDATES & ACCEPTANCE

Broadway Hardware Store reserves the right to revise, modify, expand, replace, interpret, or update these Terms & Conditions at any time without prior notice.

  • Continued entry onto Store property, continued purchases, continued participation in programs, continued account usage, continued payments, or continued interaction with Broadway Hardware Store constitutes acceptance of the most current version of these Terms & Conditions.
